Time to Comply with SEC’s Marketing Rule Is Now, Lawyers Warn

The SEC’s rejiggered advertising and marketing rule officially took hold on November 4, and advisors who have yet to comply should hold off on ads and testimonials until they’re caught up, industry attorneys caution. So reports Think Advisor.

SEC Seal of the United States Securities and Exchange CommissionMax Schatzow, partner at RIA Lawyers, noted that the SEC plans to run “focused exams” around the new rule early next year, so advisors shouldn’t “wait another second” to comply.

The SEC adopted the rule in December 2020, but Schatzow said that some clients were still finalizing their plans as the compliance deadline hit.
